Terms of Service

You must be at least 13 years old (or the minimum age of digital consent where you live) to use the Service, and old enough to form a binding contract. If you use the Service for an organization, you represent that you're authorized to accept these Terms on its behalf.

You're responsible for activity under your account and for keeping your login and access tokens secure. Authentication is handled by our provider (Clerk). Notify us promptly of any unauthorized use. You may delete your account at any time.

"Your Content" means the conversations, memories, and other material you capture, import, or create in the Service. You own Your Content. You grant us only the limited license needed to operate the Service for you — to store, encrypt, process, and display it back to you, including sending the minimum necessary content to the AI and infrastructure providers described in our Privacy Policy.

You are responsible for what you capture. You represent that you have the right to capture and store it, and you agree not to use the Service to capture or store content you're not permitted to — including other people's confidential or personal information without a lawful basis, or material that infringes someone else's rights. Capture tools only read the sources you connect; you control what is enabled.

You agree not to:

• break the law or infringe others' rights using the Service;
• attempt to access other users' data, probe or breach our security, or disrupt the Service;
• reverse-engineer, resell, or build a competing product from the Service except to the extent the law allows;
• use the Service to store malware, or to violate the terms of the AI tools you capture from (e.g. Anthropic, OpenAI, Google, Cursor).

Mind Silo offers a free tier and paid plans. Paid plans are billed in advance on a recurring basis through Stripe until cancelled. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current billing period.

Except where required by law, payments are non-refundable and we don't provide refunds or credits for partial periods. We may change prices or plan features with reasonable prior notice; changes apply to the next billing cycle. Free-tier limits (such as the number of stored memories) may change.

The Service uses AI to extract, summarize, connect, and answer questions about your memories. AI output can be inaccurate, incomplete, or misleading. It is provided for your convenience only and is not professional advice (legal, financial, medical, or otherwise). Verify anything important before relying on it.

The Service — its software, design, and brand — belongs to Mind Silo and is protected by law. These Terms don't give you any rights in it beyond the limited right to use the Service as intended. This section doesn't affect your ownership of Your Content.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, error-free, or that captured or generated content will be accurate or preserved. You use the Service at your own risk, and you are responsible for keeping your own backups of anything important (you can export your data at any time).

To the fullest extent permitted by law, Mind Silo and its people will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold Mind Silo harmless from claims and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or the law.

You can stop using and delete your account anytime. We may suspend or terminate access if you materially breach these Terms, if required for security or legal reasons, or if we discontinue the Service. On termination, your right to use the Service ends; you can export your data beforehand, and account deletion erases your data as described in the Privacy Policy.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of- law rules. You and Mind Silo agree to the exclusive jurisdiction of the courts located there for any dispute not subject to other agreed resolution, to the extent permitted by law.

We may update these Terms from time to time. If we make material changes, we'll update the date above and, for significant changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
